  1. DEFINITIONS

MedDMO (“Mediterranean Digital Media Observatory”), herein referred as “The project”, is a 30-month action co-funded by the European Union under Grant Agreement number 101083756 (herein referred to as “the Grant Agreement”).

Within this period, the project will bring together research, fact-checking and media organisations from Greece, Cyprus and Malta with the intent to detect, analyse and expose emerging harmful disinformation campaigns and address their impacts in society and democracy in the area of disinformation and important involvement in the media ecosystems of the three countries.

“Materials” refers to fact-check articles and all information, content, data, documents (e.g. white papers, brochures, datasheets, FAQs, templates, press releases, etc.), files, text, images, photographs, graphics, videos, webcasts, publications, tools, resources, software, code, programs, applications and products made available or enabled via the Website.

“Consortium” or “Project Team” refers to all 9 partnering institutions.

Based on the  Grant Agreement, Athens Technology Center S.A. (ATC) is responsible for coordinating the communication activities related to the Project’s expected results, including the creation and management of the Website accessible at https://meddmo.eu/ (referred to herein below as this “Website”) and any other Materials included in it.

The term ‘we’ and ‘our’ refers to the Consortium members and the term ‘you’ and ‘your’ refers to the visitor of the Website.

  1. SCOPE

These Website Terms of Use (the “Terms” or the “Website Terms of Use”) contained herein, shall govern your use of this Website, including all pages within this Website. These Terms apply -to your use of this Website and, by using this Website, you expressly accept all terms of use contained herein in full. You must not use this Website, if you have any objection to any of these Website Terms of Use.

  1. YOUR USE OF THE WEBSITE

You agree to use the Website and the Materials only for purposes that are permitted by the Terms of Use and any applicable law.

You specifically agree not to access (or attempt to access) any of the Materials, through any automated means (including use of scripts or web crawlers), or by hacking, password mining or other means. You agree that you will not engage in any activity that interferes with or disrupts the Website (or the servers and networks, which are connected to or accessible through the Website).

You may view the Website and its Materials, and print part of the Materials from the Website for your own personal and private use, or for the purpose of illustration for teaching or scientific research, to the exclusion of any commercial use, to the extent and as permitted by European copyright law, on the understanding that any copy or extract of said Materials maintain all intellectual property notices including all disclaimers contained therein.

You must not use this Website to copy, store, host, transmit, send, use, publish or distribute any material, which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software. You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this Website without our express written consent.

You also agree not to use the Website’s domain name as a pseudonymous return e-mail address; not to disrupt, interfere or inhibit any other user from using the Website or other linked sites, or the Materials; and not to use any Materials in a manner that infringes any Intellectual Property Rights or rights of any party.

You may not copy, reverse engineer, create a derivative work of, or decompile or otherwise attempt to extract the source code of the Website or any part thereof, unless you have been specifically permitted to do so with our prior express and written authorization.

 

  1. COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS

As between the Consortium and you, except for third parties content included in or used to carry out the fact-check articles (as discussed below), the members of the Consortium are the sole owners of the Website, all its components and any Materials displayed on the Website. The Website and the Materials are protected by European and international copyright and other intellectual property laws and treaties. 

When the Materials are fact-check articles, third parties content included therein or used to produce such fact-check articles are so to the extent necessary for the verification to be carried out. The members of the Consortium hold no license in and to any such third parties content, whatever their form: text, photos, videos, sound bites, graphics, protected works, trademarks, logos, emblems, software, tools, programs or any components thereof, etc. The members of the Consortium hold no authorization from the individuals or entities who may be depicted in such third parties content, or from the owners of depicted trademarks, works, events, or from any other individual or entity who may hold intellectual property rights, neighboring rights (including, without limitation, moral rights and performers’ rights), publicity rights, privacy rights or any other rights in and to such third parties content.  

Except as set out herein, you may not reproduce or communicate to the public any of the Materials available on this Website, without the written permission of the respective copyright owner.

  1. TRADEMARKS, TRADE NAMES AND LOGOS

All trademarks, trade names and logos appearing in the Website are the property of their respective owners and are protected by the international copyright and trademark laws. You agree not to defame or disparage the Project and all trademarks, trade names or logos included in the Website or in the Materials. Any use of any of the trademarks, trade names and logos appearing on the Website without the express written consent of the respective owner of the trademark, name or logo, as applicable, is strictly prohibited.

The Website may contain links to other internet sites and services that are operated and maintained by third parties. You acknowledge, understand and agree that we will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, products or services available on such other sites.

We reserve the right to modify, suspend, or discontinue any portion of the Website and Materials at any time, with or without notice. We reserve the right to modify any part of these Terms of Use at any time. Any modifications shall become effective upon posting on the Website. You agree to review these Terms of Use periodically so that you are aware of any such modifications. Your continued use of the Website after any such modifications have been posted shall be deemed your acceptance of any modifications to the Terms of Use. If, at any time, the Terms of Use are not acceptable to you, you should immediately cease use of the Website. You agree that the above-stated standard for notice of modifications is reasonable.

The Website, the Materials and, as for fact-check articles, any third parties content which may be included in or used to produce the fact-check articles, are provided “as is”, without warranty of any kind, whether express or implied, including fitness for a particular purpose and non-infringement of third parties rights. You are responsible for making your own verification and assessment of the Materials and are solely responsible for the consequences of any decision made or transaction carried out on the basis of any Materials available on the Website. Your use of the Website and the Materials is under your sole and full responsibility. 

In no event shall the members of the Consortium be liable for any damages whatsoever arising out of or relating to your access to or use of, or your impossibility to access or use, the Website or the Materials.  

  1. JURISDICTION

By accessing this Website, and the Materials, you agree that all matters relating to your access to, or use of them, shall be governed by the statutes and laws of Greece (country where ATC is based) and European Union, without respect to conflicts of laws principles thereof. Any disputes arising out of the use of this Website will be subject to the exclusive jurisdiction of the Courts of Athens, Greece.

If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
